Case Brief Structure
For law purposes and HBR article review purposes, a case brief has 5 main sections, a statement of facts, an issue statement, a black letter rule section, a reasoning section, and a holding or conclusion.
Statement of Facts
The fact section is a quick summary of only the essential facts of the case. For instance, in Torts, if you are trying to decide who was negligent in a certain case and the case tells you that a girl ran a red light while wearing a green dress, the fact that she ran the red light is an essential fact, the fact that she was wearing a green dress is of no consequence so you leave that part out.
The issue statement should be a statement, in question form, of any critical or main issues in the case. It is a statement of some problem that a company or a person in the case is facing that you are trying to address. So for example, if the case is about ABC corporation, which suddenly lost an exorbitant amount of profit because of environmental factor X, the issue statement might read something like, How can ABC Corporation create a contingency plan to be more prepared in the future against the ill effects of environmental factor X? You might even add in a few very important facts from the case to make the issue statement more specific.
Black Letter Rule
The black letter rule section is where you pull out the rule of law and state it in a clear and concise manner. In an HBR case, you can do this by pulling out any business concept or theory the case author was trying to teach with that specific case.
The conclusion section is simply where you answer the question posed in the issue section. For instance, ABC can prevent future loses from environmental factor X by…
Reasoning. . . Application
The reasoning section is the most important section, this is where you state the reason you came to your conclusion. It is the why? section. ABC Corporation should solve their problem like this and this is why.Being in the business for a long time meeting the requirements of students from all over the world has helped us become the best essay writing services provider.
